The UN has placed an arms embargo on the DRC. This applies to any recipient anywhere in the country, with the exception of the UN Mission to the DRC (MONUC), the EU force in the DRC (EUFOR), and the national army and police forces. Supplies of non-lethal military equipment intended solely for humanitarian or protective use, notified in advance to the Committee of the Security Council established by SCR 1533, are also exempted. The EU has adopted a Common Position in support of these measures. The UN has also placed an embargo on arms that might be re-exported to Rwanda.

Measures:

  • Extends existing sanctions until 31 December 2009; These are:
  • Arms embargo on whole territory of the DRC, with exemptions for MONUC, EUFOR and integrated forces of the DRC army;· Ban on any kind of assistance to illegal armed groups, including financial and military assistance;
  • Travel ban and asset freeze on those designated by UN Sanctions Committee as acting in violation of the arms embargo, or leading armed groups and blocking their demobilisation.
  • Renews the mandate of the Group of Experts (which monitors the sanctions);
  • Extends the criteria for sanctions on individuals to include political and military leaders recruiting or using child soldiers in DRC.

Measures:

  • freezing of funds and economic resources and restriction of admissions of persons who act in violation of the arms embargo:
  1.  persons who act in violation of the arms embargo,
  2.  leaders of foreign armed groups operating in the DR Congo who impede disarmament and the voluntary repatriation or resettlements of combatants,
  3. leaders of Congolese militias who impede the participation of combatants in disarmament, demobilisation and reintegration processes,
  4. leaders recruiting or using children in armed conflict,
  5. individuals committing serious violations of international law involving the targeting of children in situations of armed conflict
  • repeal of Common Position 2005/440/CFSP
